Forfeiture of Lease
This option is currently unavailable for use in regards to rent arrears until 25th March 2022 (this date has just been extended from 30th June 2021), but forfeiture can still be used for a substantial breach of the terms of the lease, such as unauthorised change of use.
CRAR (Commercial Rent Arrears Recovery)
CRAR is now adversely effected by current Coronavirus legislation and currently requires rent to be owing for up to 457 days.
Residential evictions
Such evictions recommenced from 1st June 2021, subject to Warrant or Writ of Possession being granted by the Court.
Commercial evictions
Commercial evictions for rent arrears have now been banned for a further 9 months, meaning that subject to additional regulation, the current moratorium has now been extended until March 25th 2022.
Evictions of Trespassers or Travellers
Such evictions are unaffected by Covid-related restrictions, whether carried out following Court action, or under Common Law.
