Certificated enforcement agents (Bailiffs) charge fees when they are instructed to recover a debt.     
Their fees are added to the outstanding amount owed by the debtor.  
These are non-negotiable fees that are set by the Ministry of Justice.

If the offer is accepted, this MAY prevent some of the cost of the agent's fees being added to the debt.

Enforcement Agents Powers

Enforcement agents have the legal right to enforce payment of debts by virtue of the Certification of Enforcement Agents Regulations 2014.
Their involvement will usually be the result of a successful Court application by the creditor to recover monies owed.

What happens if we visit a debtor's premises

If a certificated enforcement agent (bailiff) cannot obtain full payment, or agree an acceptable payment regime, then goods will be identified and either listed on a controlled goods agreement, pending payment, or removed to pay the debt.  
Any goods seized, may be placed in storage, until they are sold at public auction.

Whilst the police enforce the criminal law in the UK, Certificated Enforcement Agents are the law enforcement agents for enforcing the civil law in England and Wales.  Certificated Enforcement Agents also exercise common law powers on behalf of landlords in evicting trespassers and repossessing property under trespass and Tort Laws.

 

A Certificated Enforcement Agent is a person with legal authority to enforce the payment of debts by seizing the debtor's goods.  They also have the power of arrest when executing an arrest warrant on behalf of Magistrates' Courts.


Enforcement is the ultimate conclusion of the legal process in circumstances where all else has failed, and the High Court relies for much of it's enforcement on professionals, HCEOs and Enforcement Agents, who are officers of the Court acting under direction of the Court, but who are nonetheless independent of the Court Service and are instructed by the judgment creditor.
